SALEM – A Lynn man was found guilty by a Superior Court jury of pulling a loaded gun on a Lynn man at an auto repair business on Essex Street in the winter of 2006.Roberto Santiago, 42, of 202 Essex St., Lynn, was convicted Tuesday afternoon of possession of a firearm without a license and assault with a dangerous weapon, but innocent of possession of ammunition.Jurors deliberated over a two-day span before reaching their split decision.However, because Santiago has prior convictions for drug and violent offenses, there will have to be another trial to determine if the priors qualify as convictions against him. If so, Santiago faces a mandatory minimum of 15 years in state prison, said Assistant District Attorney Michael A. Sheehan.The case has been continued to July 15.In the meantime, Santiago remains held in custody.Sheehan presented evidence that on the morning of Feb. 23, 2006, Santiago pulled a .22 caliber firearm on a worker of an auto repair business, who he claimed was talking too loudly with a group of other men under his second-floor window.When police arrived, they arrested Santiago and swept the radius looking for the firearm, which was found in a narrow alleyway between the two buildings along with loaded magazine clips of ammunition in a box.Santiago did not take the stand in his own defense. His attorney, Joseph Morris, maintained when he was arrested there was no gun where he was to tie him to it, but jurors thought otherwise.Judge Thomas R. Murtagh presided over the four-day jury trial in Salem.
