SALEM – Jury deliberations in the murder trial of Kathie DeFelice, accused of fatally stabbing her boyfriend in 2006, took a turn after one of the deliberating jurors was replaced after he revealed to other jurors that he worked with and knew one of the defense experts, whom he said, “doesn’t know anything.”As jurors, comprised of six women/seven men, continued their second day of deliberations on Wednesday morning, an episode apparently happened around 11:30 a.m. in the jury room when a note was sent to presiding trial judge David A. Lowy, saying one of the jurors is attempting to discredit testimony of retired Danvers Lieutenant Jon Tiplady, that he was a traffic cop and he had worked with him and “he doesn’t know anything.”Tiplady had testified during the trial about battered women syndrome during the trial as an expert for the defense.The note also asked the judge as to what the protocol is for all of this.Lowy immediately called down the jury, told them to stop deliberating, then questioned the foreman and two more jurors concerning the note.Juror number 6, Richard Rogers, was questioned. He told Lowy that he had worked with Tiplady on various traffic issues in the town of Danvers. Then following a side bar, out of the public’s ear with the judge, prosecutor and defense lawyers, the judge returned and told Rogers he was excused from the case and he was escorted out of the courthouse.Then the judge individually polled each juror and it was decided to continue with the trial, even though defense lawyer Edward L. Hayden demanded a mistrial, but the judge denied his request.One of the two alternates who initially heard the case, a female, was selected to sit on the deliberating jury panel.Lowy carefully then instructed the jurors, now seven women and five men, to start their deliberations all over.The jury panel deliberated for about one half hour before they were released for the day. They will return on Thursday morning to continue mulling over the evidence.DeFelice, 48, who last lived in an apartment at 27 Union St., Lynn, is on trial for the first-degree murder of 55-year-old William H. Olsen, II, of Danvers on Oct. 30, 2006.Olsen died from a single stab wound to the heart.DeFelice doesn’t deny that she stabbed Olsen, but maintains she acted in self-defense after years of abuse.However, the commonwealth says she committed deliberate pre-meditated murder and that she made up the story about being attacked in her apartment by Olsen.Jurors have four options to consider in their verdict: Innocent, guilty of first-degree murder, second-degree murder or manslaughter.
