SALEM – Although Dari Fabian of Lynn was acquitted by a jury on charges of rape and sexual assault Friday afternoon, he will be immediately deported back to his native country.Fabian, 39, who last lived at 224 Kings Hill Drive, in Lynn, went on trial this week on charges of rape and indecent assault and battery on a person over 14.Prosecutors accused him of raping a 17-year-old Beverly girl who was babysitting his girlfriend?s children in an apartment on Folly Pond Road in Beverly on Jan. 13, 2007.Jurors deliberated over a two-day span, acquitting him of both charges.However, because he is here illegally and apparently has exhausted all his opportunities for appeals, he will be deported to the Dominican Republic, according to Assistant District Attorney Jean M. Curran.
