SALEM – A Lynn felon facing a mandatory 10 years in state prison if convicted of dealing cocaine pleaded innocent Thursday and was returned to the Middleton Jail to await trial.Kenny McDonald, 30, of 14 Perkins St., pleaded innocent to charges of trafficking over 100 grams of cocaine, possession of a firearm, being a felon in possession of a firearm and possession of a firearm in the commission of a felony.Superior Court Judge Howard J. Whitehead set his bail at $8,000, despite a strong argument by Assistant District Attorney Michael A. Patten that it stay at $10,000 cash.Patten told Whitehead that the bail had already been reviewed in Superior Court and reduced from $25,000.He acknowledged that most of McDonald’s record had motor vehicle charges, while pointing out that McDonald had 16 defaults on his record, four probation violations and three restraining orders.Patten said the case stemmed from a midnight raid on April 19 at 19 Perkins St., when authorities went there with a search warrant for a second-floor apartment and “fell into this” during their investigation.Authorities searching the second floor found an annex to a room in the attic where McDonald was living.Inside the room, authorities said they found over four ounces, or 122 grams, of cocaine, as well as a .22 semi-automatic Smith & Wesson firearm behind a vanity in his room.Defense lawyer Robert M. Linnehan, Jr., argued that authorities had no legal right to search his room, that the warrant is defective, and that he will prevail on a preliminary trial motion to toss out all the evidence seized from there.He also denied the drugs were his client’s as he asked the judge to reduce it to $8,000 – a bail that his family might be able to make, he said.Whitehead agreed to reduce it by $2,000 with the conditions if McDonald is bailed he is to report twice a week to probation until his case is resolved.
