SALEM – A Lynn man charged with fatally shooting a man in the head in June has been indicted by a grand jury.Joseph T. Graciale, III, 27, 55 Curwin Circle, Lynn, stands charged with premeditated first-degree murder in connection with the June 8 shooting death of Raphael Andino.Andino, 43, of Lynn was shot in head in the parking lot on the Johnson Street side of City Hall across the street from District Court.According to witnesses, Graciale had challenged Andino and went to the scene by car.Andino also arrived in a car, but did not get out. Graciale apparently exited his vehicle, walked around to its trunk, pulled out a gun and fired three or four shots.One shot entered and exited Andino’s head. He died at Beth Israel Hospital in Boston.Graciale fled the scene and was arrested the following day on Harbor Street in Salem.It is not known at this time the motive for the incident.The indictment handed up by the grand jury Friday afternoon now moves the case from Lynn District Court to Superior Court where Graciale will be re-arraigned within a few weeks.In the meantime, he remains held on a no bail status at the Middleton Jail.A conviction for first-degree murder carries a life sentence, with no chance of ever being paroled.Assistant District Attorney Gerald P. Shea is prosecuting the case for the commonwealth.
