SALEM – A Lynn man caught dealing heroin for the second time remains held on $750 cash bail and was returned to the Middleton Jail to await trial, after pleading innocent.Jessy Aponte, 35, of 100 Willow St., appeared Monday morning in Salem Superior Court for his arraignment. He pleaded innocent to a charge of distribution of heroin, second offense, a crime that will net him a mandatory five-year prison term.Judge Howard J. Whitehead set the same bail as previously set in Lynn District Court at the joint recommendation of Assistant District Attorney Marsha H. Slingerland and defense lawyer Mark Schmidt, and left the door open for a bail review at another court hearing.The charge stems from his arrest in Lynn on June 10 when he allegedly sold heroin to an undercover officer in a hand-to-hand drug deal on Union and Munroe streets.Aponte previously was convicted of heroin distribution out of Lynn District Court in 1996.He is scheduled to be back in court on Oct. 22 for a pretrial conference.
