LAWRENCE – District Attorney Jonathan W. Blodgett’s office was forced to drop charges against two men authorities said stole $60 at gunpoint from a Lynn man on Union Street in 2008 because the alleged victim in the case could not be found.Matthew Quon, 21, of 420 Essex St., Lynn, and Gary Elliott, 23, of 4 Otisfield Road, Dorchester, stood charged with armed robbery, possession of a sawed-off shotgun and possession of a firearm. The charges were related to the commission of a felony in connection with the holdup of a then 18-year-old Lynn man in a hallway of an apartment at 19 Union St. on Feb. 28, 2008.On the day of the trial last week in Lawrence Superior Court, Assistant District Attorney John B. Brennan reported to Judge Richard E. Welch, III that the victim in the case could not be located and without the victim the commonwealth had no case against the two suspects.Brennan said he asked for additional time to try to locate the victim, but the judge felt the commonwealth had enough time to locate the victim and the case was scheduled for trial. When police arrested the two suspects following the robbery on Fayette and Essex streets, police found a quantity of cocaine and marijuana on Elliott. He pleaded guilty last week to possession of cocaine and marijuana and received a year of probation from Welch. Both men had been free on bail pending the outcome of their case.An Essex County grand jury indicted the pair in June 2008.
