SALEM – A Peabody man police caught driving drunk for his fifth time and on a suspended license earlier this year has been indicted by an Essex County grand jury.Michael Rinker, 30, of 38 Keyes Drive, is charged with operating a motor vehicle while under the influence of alcohol, a fifth offense, as well as operating a motor vehicle without a license.The charges arise out of an incident in Peabody on March 25 when he allegedly got into a verbal altercation with his former co-worker at the Jiffy Lube on Andover Street.The co-worker flagged down a state trooper for assistance, but Rinker apparently did not stop, jumped into a white Cadillac and took off down Route 114.The trooper pursued him down the highway, eventually pulling him over.Rinker reportedly showed signs of impairment and an odor of alcohol was observed. He also failed several sobriety tests administered by the state police officer. The trooper placed Rinker under arrest.At the time of the incident, Rinker’s license had been suspended for prior drunken driving charges. He reportedly has four priors all out of New Hampshire.The indictments handed up now move the case from Peabody District Court, where Rinker pleaded innocent, to Salem Superior Court, where he will be re-arraigned within a few weeks.In the meantime, Rinker remains held without bail at the Middleton Jail after being found to be a danger.Assistant District Attorney Jennifer Kirsherbaum is prosecuting the case for the state.Indictments are a legal process that allows a case to be transferred from District Court to Superior Court, allowing for a more severe punishment. It is not an indication of guilt.
