SALEM – A Lynn man facing a potential life sentence for statutory rape of a teenage girl over a two-year span remains held at the Middleton Jail on $15,000 cash bail, after saying he is innocent. In Salem Superior Court Wednesday morning, Francisco Ortiz, 33, of 6 North Federal St., entered his innocent plea to two counts of statutory rape of a child as well as two counts of indecent assault and battery on a mentally retarded person before Judge Timothy Q. Feeley. As jointly requested by both the prosecutor and defense, the judge ordered that Ortiz remain held on the same bail amount as previously established in Lynn District Court and agreed to leave the door open for a bail review hearing at the next court date and continued the case to July 12.In the meantime, Ortiz will have to come up with $15,000 cash in order to get out of the Middleton Jail pending his trial. The allegations arise from incidents at his home between March 22, 2008 and March 23, 2010 where the girl says she was raped and inappropriately touched by the accused. The victim is a family member who was 13 years old at the time the first incident occurred. The incidents were initially disclosed to friends on a bus. The bus driver apparently overheard the girl discussing the incidents and reported it to a teacher and ultimately it was turned over to authorities. The penalty for rape of a child carries a potential life sentence in state prison and the punishment for indecent assault and battery on a mentally retarded person carries up to 10 years in state prison.
