SALEM – One of two Marblehead teens charged in the violent robbery and brutal beating of a junior high school boy in Marblehead last fall pleaded guilty and will serve 18 months in jail to be followed by three years of probation.Michael D. Leoni, 18, of 14 Devereux Terrace, confessed Tuesday afternoon in Salem Superior Court to some reduced charges.He pleaded guilty to a lesser offense on two charges of larceny from a person as well as two counts of assault and battery causing serious bodily injury and a single count of assault and battery before Judge Timothy Q. Feeley.He was handed a split sentence of 30 months in jail, with all but 18 months suspended and placed on three years of probation.In handing down the punishment, Feeley described the case as “shocking” and hoped by incarcerating Leoni that he can be rehabilitated.Leoni, along with his alleged co-defendant, Michael Ehlert, attacked the 16-year-old Marblehead teenager as he was walking to a downtown convenience store near the cemetery around 7 p.m. on Oct. 29.The mother of the victim told Feeley in her impact statement that she will always have a memory of how her son was “savagely attacked” and how Leoni actually sat in her kitchen and ate food as they threatened her son if he snitched following the beating.”He took part in nearly killing my son,” the mother emphasized to Feeley, adding, “I fear more for society the day Mr. Leoni is released.”The victim, now age 17, was beaten about the face and was choked by Ehlert after being dragged into the graveyard, according to reports.As the victim was being beaten, Leoni rummaged through his pockets, saying, “Where is the money?” and then stole his cell phone and wallet, recounted Assistant District Attorney Kristen R. Buxton from a police report.Leoni also kept encouraging Ehlert to hit the victim with his other fist as he kicked him, Buxton said.The two men then discussed with the victim that if his mother questioned him about his injuries he was to say a Hispanic person from Lynn beat him.Then they escorted the victim back to his home on Ramsey Road, concealing his injuries along the way as cars passed them by putting his hood over his head.When they got to the victim’s home, Ehlert marched him in and ordered the victim to turn over his iPod to him, while Leoni waited outside.But in the meantime, Leoni went inside the house and began eating Chinese food in the kitchen, which the victim’s mother had ordered for him earlier.Leoni and Ehlert stayed in the house for a while as they threatened the victim not to say anything about the incident. Ehlert reportedly told the victim he would have his mother raped and his throat slit if he told anyone.When the victim’s mother returned home from getting a massage, she found her son badly beaten, but the mother was in fear of retaliation by them because they had previously bragged around town about ties with gangs.The victim was taken to Salem Hospital where he was diagnosed with a concussion, swollen eyes and numerous bruises around the throat.Buxton urged the judge to sentence Leoni to the sentence imposed. In asking for the punishment, Buxton explained that Leoni “actively participated and encouraged” his partner to seriously beat the victim.She explained she took into account his age, which was 17 at the time, and that the victim was 16 at the time, but noted the impact the incident has had and will continue to have on the victim’s entire life.”This was a fellow student and had shared common activities in the town. This crime was face to face to someone they knew and who was younger,” Buxton pointed out as she explained how the victim had to leave his school, friends and the town out of fear and remained out of the commonwealth.Defense lawyer Jill S. Gately pleaded with the judge to consider a lesser punishment of probation, saying her client has “struggled with school because of medical issues in his earlier years, such as bipolar and ADHD disorders.She said he always was over-med
