LYNN – The former owners of the Golden Lakes restaurant on Bennett Street who allegedly transferred the business and property to avoid paying off a commercial promissory note of approximately $125,000 are being sued by the bank for non-payment.Rockland Trust Company, of 288 Union St., Rockland, brought the eight-count court litigation into Salem Superior Court against Golden Lake, Inc., of 38 Bennett St., former owners, Nath Suong and Samol Om, of 551 Summer St., Lynn, as well as Leang Sor, of 36 Lambert St., Revere.The complaint states that in December of 2008, Suong and Om took out a guaranty with Rockland in a commercial promissory note.Rockland believes that on or about Dec. 2, 2009, without notice or authorization from the bank, they signed a purchase and sale agreement with Sor.Sor took possession and or converted the collateral to his own personal use to the detriment of Golden Lake creditors, including Rockland, the suit states.Rockland maintains that Golden Lake, Suong and Om transferred the ownership without receiving a reasonably equivalent value in exchange for the fraudulent transfer and that the intention is to deliberately defraud Rockland, which constitutes unfair and deceptive trade practices.Rockland is seeking to recover the sum of $124,716.99 due to them including cost of collection, court costs, legal expenses and fees.Also named in the complaint as defendants are RBS Citizens, N.A., 35 Washington St., Lynn, and St. Jean’s Credit Union of 250 Maple St., Lynn, who are holders of monies, goods and credits standing in the name of Suong, Om, or Golden Lake, the complaint states.Judge John T. Lu allowed a $125,000 attachment prohibiting the defendants from withdrawing or concealing the credits at RBS Citizens and St. Jean’s Credit Union until the case can be resolved.A hearing on the complaint has been scheduled for Aug. 29 for the accused to answer the complaint and argue the approval of an attachment concerning the liquor license at the establishment as well a real estate attachment.In 2007, Golden Lakes was the site of a fatal shooting in a gang-related incident in which Cristian Vargas-Martinez, 18, a member of the Crips gang, was shot in the chest with a single bullet outside the restaurant on the late afternoon of Nov. 1.Kevin Keo, 18, a member of the Bloods gang, was found guilty of first degree murder for the death of Vargas-Martinez and is currently serving a life sentence behind bars.A second man, Bonrad Sok, 19, also a member of the Bloods gang, was convicted of a lesser charge of second-degree murder instead of first-degree murder. He currently is serving a life sentence behind bars, but will be eligible for parole after 15 years. If he is paroled, he will be on lifetime parole supervision by authorities.
