SALEM – A Peabody cook who admitted beating and threatening to kill his estranged wife inside a Beverly Farms pizza shop in 2009 received five years in state prison.Ilirian Piku, 45, formerly of 15 Harris St., Peabody, changed his to guilty Monday afternoon to charges of assault with a dangerous weapon, assault and battery, assault and battery with a dangerous weapon, carrying a firearm without a license and being a felon in possession of a firearm before Salem Superior Court Judge John T. Lu.Piku, an Albanian native, was sentenced to serve five years behind bars. Upon his release from prison, Piku will be on probation for another five years, will have to complete a batterers program and will be evaluated for substance abuse treatment and counseling.Assistant District Attorney Greg A. Friedholm said the charges arise from an incident that occurred shortly before 9 a.m. on May 6, 2009, when Piku walked into Harry’s Pizza and Deli, located at 728 Hale St. where his then 32-year-old estranged wife was working.At first, Piku asked her if she needed help, but then he grabbed her cell phone from the table and began hitting her on the back of the head, she told police.Piku then punched her in the face and stomach, pulled her by the hair and threatened her with a gun, saying she “did not fear or respect him.”Piku then fired one shot into the ceiling of the building from a small revolver and pointed the gun toward her and threatened her if she did not return home with him.Out of fear, she consented to go with him, but not until the afternoon, and he left.Then she called her father, who told her if she did not report the incident to police he would.She then reported it to police who arrested Piku later that day at the Peabody Coffee House, where he was known by police to hang out.Police searched his car and found a loaded .357 handgun.The couple had been separated for about three to four weeks and she had been staying with her parents in Peabody. She chose not to be present for the hearing.Police recovered a blood-stained shirt and apron from the scene as evidence. The bullet in the ceiling could not be recovered because it appeared to have ricocheted in the ceiling and ended up somewhere in the sub-floor of the apartment above the business, according to reports.Friedholm proposed a harsher punishment of six to eight years in prison with probation, basing his recommendation on Piku’s history of abuse, which he said escalated over the years.Defense lawyer William F. Delaney urged the judge to be lenient, suggesting three years in prison and probation.The judge agreed to credit Piku the 219 days he has spent awaiting trial on the case.Piku has been serving a sentence on a probation violation imposed in December for an assault and battery with a dangerous weapon in an unrelated case.
