SALEM – A Lynn man already charged for trying to kill an 18-year-old teen on Timson Street in May now faces a first-degree murder charge stemming from the 2009 shooting death of Vincent K. Gaskins.Assistant District Attorney James P. Gubitose presented evidence Wednesday to an Essex County grand jury who later handed down two new indictments against Darkens Bonnett.Bonnett was charged with murder in the first degree and carrying a firearm without a license in connection with the Nov. 22, 2009 shooting death of Gaskins.Gaskins, 30, who lived at 159A Essex St. in Lynn, was shot once in the head at about 1:20 a.m. with a .22 caliber handgun in the parking lot outside Soriano’s Nightclub at 41 Market St.When police arrived at the scene they found Gaskins unresponsive to medical treatment.His girlfriend, Ashley Auger, 24, desperately tried to perform CPR on Gaskins before he was transported to Salem Hospital by ambulance and then air-lifted to Boston Medical Center.He was put on life support because he was deemed brain dead. A few days later the family reluctantly removed him from the life support and he died.She told police that she and Gaskins were walking through the nightclub parking lot when a man began speaking to Gaskins. As she kept walking towards her car, she heard gunshots and saw a blue Audi speed from the scene.Auger said that Gaskins and the man had an ongoing misunderstanding.Investigators found the alleged weapon, a firearm, near the scene of the crime.Gaskins had more than 60 arraignment dates for criminal offenses including armed robbery, firearms possession and restraining order cases.The murder case remained unsolved until four months ago when police got a break and charged Bonnett with the fatal shooting of Gaskins.Bonnett, 19, of 16 Osborne St., Lynn, is also charged in Superior Court with attempted robbery, assault and battery with a dangerous weapon, firearm and stolen property charges, allegations he has denied.Those indictments arise out of an incident in Lynn in the early morning hours of May 18 when Bonnett and his co-defendant, Brandon Payne, 21, allegedly tried to rob an 18 year old as he was walking towards his home on Timson Street.When the victim, Elder Palmer, started running away, he was shot in the chest and buttocks, allegedly from the attempted hold-up men.Palmer was taken to Union Hospital with non-life threatening gunshot wounds and was released.Payne, who pleaded innocent, has been deemed too dangerous to be released into the community pending his trial on those charges by Superior Court Judge John T. Lu.Bonnett remains held without bail at the Middleton Jail following his arraignment on the murder charge in Lynn District Court.His next scheduled court date in Salem Superior Court for the most recent charges is set down for Oct. 13.Assistant District Attorney James P. Gubitose is prosecuting both cases.Attorney Michael Phelan of Lynn is Bonnett’s court-appointed defense lawyer on both cases.
