SALEM – A 47-year-old Lynn man accused of raping and indecently touching his cousin’s girlfriend over a three-month span was indicted Wednesday afternoon on numerous charges by an Essex County grand jury.Fred S. Kummel, 47, of 76 Park St., #10, stands charged with two counts of rape, five counts of indecent assault and battery on a person over the age of 14 and three counts of assault with intent to commit rape.The charges arise out of incidents that began in May when the 28-year-old victim told authorities that Kummel, who lived across the hall from her, inappropriately touched her breasts, twice asked her to perform oral sex on him, attempted to rape her and exposed himself to her.Then, in June, he allegedly raped her in her apartment. The victim told police she tried to fight him off, but was unsuccessful. Before leaving the apartment, Kummel warned her not to tell anyone about the incident.Then between July 1 and July 31 Kummel again tried to rape her, but was unsuccessful.At some point during the episodes, the victim sought a harassment order against Kummel in Lynn District Court.It wasn’t until Aug. 5 when she told her 48-year-old boyfriend, Kummel’s cousin, of the incidents and they went to police.When police questioned Kummel he apparently denied the incidents.The 10 indictments handed down now move the case from Lynn District Court, where Kummel has pleaded innocent, to Salem Superior Court where he will be re-arraigned within a few weeks.In the meantime, he remains held on $5,000 cash bail at the Middleton Jail.Kummel faces up to 20 years in state prison on each of the rape charges, if convicted.Assistant District Attorney Jean M. Curran is assigned to prosecute the case for the state.
