SALEM – A self-employed mason charged with raping a 19-year-old woman at his home earlier this year appeared for his arraignment, but ended up behind bars on $5,000 cash bail.Douglas Garcia, 38, of 17 Leavitt Place, #2, Lynn, had been released earlier from the Lynn District Court following his arraignment last April with conditions he report to probation, stay away from the 19-year-old woman, turn in his passport to probation and not leave the state without permission.But Salem Superior Court Judge John T. Lu set the $5,000 cash bail after Assistant District Attorney Karen Hopwood asked the judge to set $20,000 cash bail, while pointing out that Garcia faces a potential 20-year prison term.The 19 year old told investigators she awoke around 2 a.m. and found Garcia lying naked next to her. She realized her pants had been pulled down to her ankles and had been sexually assaulted.She quickly jumped out of bed and Garcia also jumped up, saying “I’m sorry” and left the room, according to the prosecutor.Hopwood told Lu that Garcia, who is Guatemalan, had earlier turned in his passport to probation in Lynn as part of his conditions of bail, but several days ago tried to get it back, suggesting to Lu that he may have been trying to leave the country.But defense lawyer Mark S. Horrigan disputed that claim, stating his client’s passport is his only means of identification and he needed it to cash a check at the bank.Horrigan explained to Lu that his client has no record of arrests or defaults, has ties to the community, is a self-employed mason and strongly denies anything occurred.After carefully reviewing the grand jury minutes in a copy provided by the prosecutor, Lu ordered that a $5,000 cash bail be set.Garcia was placed into custody and taken to the Middleton Jail. He will have to come up with $5,000 cash in order to get out of jail pending his trial.His next scheduled court appearance is on Oct. 20.
