SALEM – A Lynn man and a Swampscott resident were indicted Wednesday afternoon on separate cases involving child rape and armed robbery crimes by an Essex County grand jury.Carlos Filberto Orozco, 28, of 262 South Common St., #1, Lynn, is charged with rape of a child, two counts of posing a child for sexual pornography as well as two counts of posing a child in a state of nudity.The allegations arise out of an incident on Aug. 29 when Orozco allegedly was caught photographing his uncle’s 4-year-old daughter nude.Authorities responded to the scene around 5:30 p.m. on Aug. 29. The victim’s father informed police that he was sitting in the living room with one of his daughters when he got up to check on his wife and his other daughter.When he returned, he saw his nephew, Orozco, kneeling on the floor in front of his daughter who had her underwear off and her shirt pulled up while Orozco was taking pictures of her with his cellular phone.The father grabbed the cellular phone from him and apparently found other pictures of his daughter nude.Police later examined the iPhone and discovered pictures of close-ups of the victim’s genitalia area, of Orozco apparently touching the child’s genitalia and the girl naked.The child was later taken to North Shore Children’s Hospital for examination.The indictments handed up by the grand jury now move the case from Lynn District Court, where Orozco has pleaded innocent, to Salem Superior Court, where he will be re-arraigned within a few weeks.In the meantime, Orozco remains held without bail.Assistant District Attorney Karen Hopwood is prosecuting the case for the commonwealth.Also indicted was Joshua Enos, 19, of 34 Hillcrest Circle, Swampscott, charged with armed robbery in connection with the Oct. 5 holdup of Spiro’s Gas Station located at 620 Humphrey St. in Swampscott where $300 was reported stolen at gunpoint.Enos was arrested and charged last month in connection with the holdup.The case went unsolved until police were able to match a DNA profile apparently linking Enos to the case.Assistant District Attorney A.J. Camelio is assigned to prosecute the case.Indictments are not an indication of guilt, rather it is a legal process that allows a case to be transferred from District Court to Superior Court, allowing for a more severe punishment.
