SALEM – A Revere man, who was free on bail while facing breaking and entering, larceny and assault charges, found himself locked up at the Middleton Jail after a vial of urine was found on his person.Michael Anzilotti 41, of 417 Revere Beach Blvd., Revere, appeared Tuesday afternoon in Salem Superior Court for a status review regarding his pending case.Defense lawyer Steven J. Topazio told Judge John T. Lu that the gastric bypass surgery procedure his client was scheduled to have was instead delayed and that his client was now on pretrial release from another case in Boston.Assistant District Attorney Kristen Buxton quickly intervened, telling Lu that the case in Essex County, a 2009 case, seems to be “dragging,” with no end. She said she was concerned because Anzilotti was just arrested in the North End with three bags of heroin.She insisted that there now are changed circumstances and asked Lu to increase his bail.Anziliotti had been free on $750 cash bail after being charged with an incident on Feb. 20, 2009 when he allegedly tried to steal tools from an elderly man’s pick-up truck parked at the Home Depot on Route 1 in Saugus.During that incident, the 61-year-old male came outside and saw the suspect trying to steal something from his toolbox. The victim confronted Anzilotti and tried to detain him, but he jumped into a Toyota Highlander, dragging the victim through the parking lot before he fell to the ground.Lu then agreed to increase his bail to an additional $2,500 cash, with the specific conditions that Anziliotti be placed on a GPS monitoring device with house arrest and he was not to be released until the GPS device was in place.Court officers then placed Anzilotti in custody and took him to the lock-up area to be transported to the Middleton Jail.However, while in lock-up, court officers saw Anzilotti trying to discard a urine vial.They notified officials and Anziliotti landed back in the courtroom.Topazio told Lu his client had brought an extra urine vial because he thought he might be drug tested by the probation department and gets nervous and can’t give a sample.But Buxton said Anzilotti was trying to trick the court.Lu ordered Anzilotti to give a urine sample, but he refused.After that Lu ordered Anziliotti held without bail pending a further hearing.
