SALEM – A Saugus man who allegedly held his wife and their young daughter captive with an arsenal of weapons was one of five local persons indicted last week by an Essex County grand jury.Benjamin David Murphy, 30, of 3023 Founders Way, Saugus, is charged with kidnapping, assault and battery, intimidation of a witness, four counts of possession of a large capacity firearm, possession of ammunition, violation of a restraining order as well as illegal possession of a rifle and shotgun.The charges arise out of an incident at their home on Aug. 10 when he went into a rage after his 25-year-old wife told him she was going out for the night with her friends. He apparently beat her and held her captive, saying he would kill her and take their 18-month old baby girl.Saugus police were summonsed to their apartment after a friend called and reported that Murphy was holding a woman and child against their will.Police forcibly entered the apartment and arrested Murphy, who was found sitting on a porch smoking a cigarette.Police searched the home with the consent of his wife and located a series of weapons in a safe in the bedroom, including a 12-gauge shotgun, a .22 caliber rifle, a handgun as well as various rounds of ammunition for the shotgun and handgun.Murphy did not have a license for the firearms or ammunition.The indictments handed down now transfer the case from Lynn District Court, where Murphy has pleaded innocent, to Salem Superior Court, where he will be re-arraigned on Nov. 3. In the meantime, Murphy remains held without bail after being deemed a danger to the community and the victim.Assistant District Attorney Jennifer Kirshenbaum is assigned to prosecute the case.Also indicted was:Cheryl Messina, 46, of 2 Hingston St., Peabody and Linda Michalski, 48, of 33 Mill St., Beverly, charged with breaking and entering in the daytime with intent to commit a felony and larceny in a building concerns a break-in in Peabody last month.On Sept. 24 at around 2 p.m., a concerned neighbor called police reporting suspicious people putting gloves on their hands as they entered his neighbor’s house at 111 Lynnfield St. and then saw two women flee from the home in a blue Hyundai.Patrolmen Al Graglia and Joseph Coup quickly responding to the scene and arrested the women.Authorities believe entrance to the home had been gained after throwing a rock through a back window. Jewelry and a laptop computer were reported stolen from the home.Both women have long past criminal records, according to Assistant District Attorney Jean M. Curran, who is prosecuting the case for the commonwealth.Oswaldo Acevedo, 39, of 62 Lawton Ave., and Keith Morley, 34, of 59 Clarendon Ave., #1, both of Lynn, charged each with two counts of carrying a firearm without a license and two counts each of unlicensed sale of a firearm stems from two incidents in Lynn on Jan. 12 and Feb. 22 when police say they tried to peddle firearms.Indictments are not an indication of guilt, rather it is a legal process that allows a case to be transferred from District Court to Superior Court, allowing for a more severe punishment.
