SALEM – A 26-year-old Lynn man who was caught with cocaine and a .22 caliber bullet in his pocket last year may spend up to seven years in state prison after confessing in Salem Superior Court.Shubar Charles, last known address of 201 Essex St., Lynn, was about to go on trial Monday, but instead opted to plead guilty to possession with the intent to distribute cocaine, illegal possession of ammunition and a felon in possession of ammunition with one prior drug offense before Judge Howard J. Whitehead.Charles was sentenced to serve not less than four years and not more than seven years in state prison. He has already served 463 days awaiting trial in the Middleton Jail, which he will receive credit for.Whitehead agreed to adopt the joint recommendation proposed by Assistant District Attorney Greg A. Friedholm and defense lawyer Christopher Norris.”Hopefully after serving a state prison sentence, he (Charles) will realize it is not worth it,” stated Whitehead from the bench as he handed down the punishment.The plea Monday spared Charles a mandatory 15-year prison term, if he would have been convicted at trial on the felon in possession of ammunition charge.Friedholm said Lynn police picked up Charles on a warrant in April 2009 and during a pat frisk police seized 20 twists of cocaine and $197 in cash from his front pants pockets. A twist is the snipped off corner of a plastic bag. In addition, a .22 caliber working bullet was confiscated from his jacket by police.Charles has prior drug convictions in 2006 out of New Bedford District Court and another in 2006 out of Lynn District Court, said Friedholm.
