LYNN – While acting on a tip, police arrested a Lynn man who was allegedly smoking marijuana while armed with a stolen Glock handgun on Broad Street Monday afternoon.Modesto Cruz, 34, of 109 Broad St., #105, was charged with carrying a firearm without a license, resisting arrest, possession of a class D substance, violation of a city knife ordinance, disorderly conduct, unlicensed possession of ammunition, receiving stolen property over $250 and felon in possession of a firearm.He was arraigned Tuesday at Lynn District Court by Judge Elizabeth Cremens and was ordered held on $25,000 cash bail. A probable cause hearing has been scheduled for Nov. 16.According to court documents, a tip was given to police saying a “fat Hispanic male with a ponytail his late 20s” was selling heroin from the back door of an apartment building on Broad Street.Police checked out the high-crime area, where numerous arrests have been made in the past for narcotics and weapon charges. They found the rear door of the apartment building in question partially ajar and walked into the hallway to check it out. As officers walked up the stairs, they saw a Hispanic man, Cruz, matching the description and immediately smelled an overwhelming odor of freshly burnt marijuana.Cruz was said to have been holding a blunt, which was lit and filling up the hallway with smoke. When Cruz was asked to step outside, he said, “Whoa, whoa, whoa” and started backing up. Police found and removed a black folding knife from Cruz’s pocket as he attempted to run up the stairs into the hallway. After struggling with Cruz for several minutes, Cruz broke free of the officers’ grasp and ran upstairs, but was caught right after. As he was being pat-frisked, police found a .40 caliber, black Glock 27 handgun in a holster attached to his belt. Police said the gun was loaded with 10 rounds of .40 caliber ammunition, which was seized along with the knife and marijuana.During booking, Cruz told police he had purchased the handgun “from a junkie” two hours before his arrest for $400 and was in the process of selling it to someone else for $600. He went on to say that he had been in the back hallway of his father’s residence waiting for the person to buy the gun when he was arrested. The weapon was later determined to have been stolen out of a vehicle in Danvers on Nov. 15, 2008.
