SALEM – A Lynn man found guilty of indecently touching his girlfriend last year in their Sheridan Street home received two years in jail and will be deported back to his native Honduras.Nelson Nunez, 43, formerly of 58 Sheridan St., Lynn, went on trial last week on charges of assault with intent to rape, indecent assault and battery on a person over age 14 and assault with a dangerous weapon arising out of an incident at his home he shared with his girlfriend in 2009.Jurors deliberated for three days, returning a split decision finding Nunez guilty of indecent assault and battery, but exonerated on the remaining two charges.Judge David A. Lowy issued the sentence.”He (Nunez) took away my trust. I ask justice be done and hope Mr. Nunez get the help he needs,” the 44-year-old victim told the judge during the sentencing hearing Wednesday afternoon in Salem Superior Court.Assistant District Attorney Michael Patten suggested a three- to five-year state prison sentence, rather than a jail term, noting the nature and surrounding circumstances of the crime itself.”This is an extremely violent act. It involved a knife. A woman was degraded in her own bed,” insisted Patten.Defense lawyer Joseph F. Collins proposed a two-year jail sentence, reminding Lowy that his client has no prior record.
