SALEM – The father of a Nahant boy who sustained severe facial lacerations after running into a sharp-edged fence while running to catch a pass during a football game at Gallagher Field last year has filed a lawsuit against the city of Lynn.Aaron Bascon, of 6 White Way, Nahant, filed the lawsuit Friday morning in Salem Superior Court on behalf of his minor son, Isaiah Bascon.The complaint states on or about May 2, 2009 Isaiah participated in an organized team activity under the North Shore Flag Football League.The game was held at the Gallagher Field in Lynn, which is owned and maintained by the City of Lynn.As Isaiah was running to catch a football pass, he ran into a protruding chain link fence post which resulted in severe facial lacerations and permanent scarring on his face.Attorney David M. Cohen, of Stoughton, who filed the complaint on behalf of Bascon, argues in the one-count complaint that the city of Lynn was negligent in maintaining the fence, which created a hazardous condition that caused Isaiah to suffer personal injury, pain and conscious suffering.The court documents list $271,112.91 in damages for hospital expenses and future hospital expenses as well as the nature of the facial scarring and disfigurement.A trial before a jury is requested from the court to recover damages with interest, costs and such other relief as deemed appropriate.
