SALEM – A Peabody couple who say they were beaten outside the Bugaboo Creek restaurant by friends of a waitress they complained about that night while at the establishment filed a lawsuit last week in Salem Superior Court.David and Sarah Henrick, of 36 Emily Lane, are suing the Bugaboo Creek Steakhouse located at 210 Andover St., on Route 114 in Peabody and an unnamed waitress for negligence for an undetermined amount of damages.On the night of Nov. 2, 2007, the Henricks were at the restaurant having dinner at the bar and, during the meal, apparently complained about their service from the unidentified waitress, only listed as Jane Doe.Approximately six individuals seated at a table in the adjacent lounge area, reportedly friends of the waitress, then began being verbally aggressive towards the Henricks.?When the Henricks went to leave they were followed and David Henrick, then 42, told police he was jumped and thrown onto a car and his wife was shoved.The complaint, filed by Attorney Timothy R. Cagle of Andover, accuses Bugaboo Creek of being negligent for failing to provide a safe environment and failing to stop the hostile and aggressive behavior towards the Henricks while inside the establishment.When police arrived, the six people allegedly involved in the confrontation were arrested and charged.The complaint lists $12,165 in medical bills, plus any other amount of monetary damages the court deems proper and just.A trial before a jury is requested from the court.
