SALEM – The case against Jose Cabrera, charged with killing a Lynn gang member on Olive Street in November 2008, is on schedule to begin trial on Jan. 4, despite the file being shredded.Last week, Ilya Ablavsky, 32, was arrested by State Police in Lynn, charging him with withholding evidence and larceny of property.Authorities say he took the Cabrera file from the Superior Court Clerk’s office on Federal Street, containing 51 documents, including impounded materials, and apparently shredded all the paperwork.Prosecutors and defense will work together to recreate the file.The trial had been scheduled to begin next month, but due to scheduling conflicts with the defense attorney, Jeffrey Karp, it had already been moved to January.Cabrera, 20, formerly of 76 Park St., Lynn, is charged with the fatal shooting of Tony Pich, who was gunned down on his front porch on Nov. 1, 2008, during an altercation between rival gang members.Pich, 21, was shot once in the chest at 1-3 Olive St., shortly before 2:30 a.m. Pich’s family members drove him to the North Shore Medical Center in Salem, where he was pronounced dead at about 3 a.m.Cabrera, who pleaded innocent, remains held at the Middleton Jail without bail pending the outcome of his trial.A conviction on the charge carries a mandatory life sentence in state prison, with no chance of parole.
