LYNN – After allegedly smothering his girlfriend with a pillow until she passed out and slicing his arm in an attempt to blame her for their blowout, a Lynn man then tried to bribe police with drugs for his release.James Martinez, 30, of 50 Andrew St., #201, was charged with two counts of domestic assault and battery, two counts of intimidation of a witness, one count of assault and battery with a dangerous weapon, pillow, and assault with intent to murder by suffocation.He was arraigned Monday at Lynn District Court by Judge Stacey Fortes-White and was ordered held without bail pending a dangerousness hearing scheduled for Nov. 30.According to court documents, Lynn Police responded to Martinez’s home on Saturday and again on Sunday, both for reports of domestic disturbances where he allegedly assaulted his girlfriend. On Sunday, police arrested Martinez, who allegedly spewed a plethora of obscenities toward the officers, saying he didn’t understand why he was being arrested.After Martinez was removed, officers spoke with his girlfriend, who was said to have been hysterically crying and shouting “Again!” and “Why me, when is it going to stop?” The victim said Martinez had argued with her and when she asked him to leave their apartment, he “snapped” and jumped on top of her, slamming a pillow down on her face.The victim said she began kicking and screaming, but became exhausted as he held her down and passed out from a lack of oxygen. She said she woke up on the floor next to her bed, but didn’t know how she got there.When she opened her eyes, the victim said she saw a droplet of blood on the floor and immediately assumed that she had an injury to her face. Martinez was said to have told her to “get up” and put his arm next to her face so that she could see a slash mark. He allegedly told her that if she called the police about the incident, he would tell them that she cut him with a knife.Still, the victim said she reached for a phone and frantically called the police for help, but halfway through the conversation, Martinez allegedly convinced her to hang up and took the phone away from her.Police say the victim declined to get a restraining order, but did say that she is afraid of Martinez, who is said to sometimes sleep in Laundromats and at the Lynn shelter. Several neighbors said the couple’s fights have been going on for weeks.During Martinez’s booking, police say he mocked them about the incident, suggesting that “women rule the Lynn Police Department.” He also said, “Officer, let me ask you this. What can I do to make this all go away. I know things about this and that. You know, drugs.”
