LYNN – A Lynn man has been accused of sexually assaulting his wife?s 9-year-old daughter while they watched television together on Sunday night.The suspect, Jose J. Minaya, 45, of 761 Summer St., has been charged with indecent assault and battery on a child under the age of 14 years old and rape of a child with force.On Tuesday at Lynn District Court, Judge Albert Conlon ordered Minaya held on $5,000 cash bail. If bail is posted, Conlon instructed him to stay away from and not have any contact with the victim and to abide by a restraining order. A probable cause hearing is slated for Dec. 21.According to court documents, the victim confided in her mother when she got home from work that Minaya had touched her inappropriately while they were watching television. The victim?s mother said she threw Minaya out of their home, saying he most likely slept in a van that night.She waited to inform police of the alleged crime because she “didn?t want to see him go to jail” and also because he is the primary bread winner for the family.Prior to going to the police, she said she brought her daughter to the Lynn Community Health Center, where she was administered a rape kit.The incident is said to have happened around 7:30 p.m., where Minaya allegedly rubbed the victim?s buttocks and put his hands down her pajama pants. After tensing up from his touch, the victim alleged that Minaya pushed her legs apart and digitally raped her.The victim said she made several excuses to get away from Minaya, saying her back hurt, but she was told to sleep in his bed if she wasn?t feeling well. At that point, the victim alleges that he lifted up her bra and continued to assault her.After a few minutes, the victim said she put on a long coat in an attempt to get Minaya to stop bothering her and said he eventually left to pick her mother up at work. She later told her mother that Minaya offered her a beer during the assault and said he “was just testing her” and for her not to tell anyone.Police tracked down Minaya at his place of work, General Electric, and arrested him. During an interview, he told police that the victim?s mother allegedly said she was “going to get him where it hurts,” tried to stab him and questioned why she waited to file a report.
