SALEM – A man who is facing a mandatory three years in state prison after being caught peddling a revolver to an undercover officer in Saugus last year will have to come up with $25,000 cash to get out of the Middleton Jail pending his trial.Tyrath Seng, 22, of 193 Donahue Road, Dracut, appeared in Salem Superior Court for his arraignment, pleading innocent to carrying a firearm without a license, possession of ammunition without a license and unlawful sale of a firearm before Judge John T. Lu.In setting the bail, Lu ordered that if Seng does post bail, he must stay at his house and can’t leave except for medical, attorney and court appointments, and will be monitored by a GPS tracking device.The charges arise out of an incident on the morning of Sept. 30, 2009 when Seng allegedly participated in the sale of a 50-caliber Smith & Wesson revolver with 30 rounds of ammunition to an undercover officer at the Applebee’s Restaurant parking lot on Route 1 in Saugus.Assistant District Attorney Marsha H. Slingerland urged the court to establish the same bail amount set in Lynn District Court of $75,000 cash, emphasizing that prosecutors have a strong case against Seng while noting that he was captured by authorities on video committing the crime and that he is facing a three-year minimum mandatory punishment and up to 15 years in state prison on the most serious charge.Defense lawyer David R. Yannetti pleaded for a lower bail, noting that Seng had strong family support and has no prior record.Seng is due back in court on Feb. 3 for a pre-trial conference.
