LYNN – A christening party quickly turned ugly on Sunday when a Lynn man allegedly assaulted a police officer and was caught with an open bottle of booze in his pocket.Hector Jose Nieves, 23, of 66 Harwood St., #1, was charged with assault and battery on a police officer, resisting arrest, disorderly conduct, assault and battery with a dangerous weapon, door, and open container of alcohol. He was arraigned Monday at Lynn District Court by Judge Albert Conlon and released on personal recognizance. A pre-trial hearing has been scheduled for Feb. 14.According to court documents, officers responded to a home on South Common Street on a report of a noise complaint around 2:30 a.m. Upon arrival, officers found two men sitting on the front porch of the residence, while loud music could be heard coming from inside the home.Police say Nieves became enraged after they asked him for his ID and for the music to be turned down. Nieves allegedly began shouting about his rights and that he was going to call his lawyer about the incident. He went on to say that he “already did time for us” and that the officers didn’t have the right to shut down his party.As Nieves was yelling, police say they noticed that the music had been turned back on, so they radioed in for extra patrols and knocked on the front door. At that point, Nieves allegedly pushed one of the officers out of the way in an attempt to go inside, but the officer grabbed onto Nieves’ jacket to arrest him. The scuffle continued as Nieves proceeded to slam a door on the officer’s arm several times in an attempt to break free from his grasp. Several people from the party then tried to pull Nieves into the apartment, but other officers got a hold of him instead and ushered him into a back room in the home.The owner came out and began kicking people out of her home and apologized to police for the commotion.Then, when Nieves was being placed into custody, officers found an open bottle of Hennessy in his back pants pocket, which was taken as evidence.
