LYNN – A Marblehead man was charged with his fourth offense of driving drunk on Saturday, after police found his van stuck in a snowbank with open bottles of alcohol inside.Terence P. Driscoll, 39, of 14 Baldwin Road, was charged with resisting arrest, disorderly conduct, marked lanes violation, negligent operation of a motor vehicle, operating a motor vehicle with a suspended license, subsequent offense, drinking alcohol from an open container and two counts of assault and battery with a dangerous weapon, shod foot.On Tuesday, Driscoll was arraigned at Lynn District Court by Judge Albert Conlon, who ordered him held without bail pending a dangerousness hearing scheduled for Jan. 25.According to court documents, Swampscott police found Driscoll’s 1995 Dodge Ram van facing southbound in the northbound lane on Essex Street around midnight, stuck in a snowbank while still running. Driscoll told police he was calling AAA for help, but when he asked in a slurred voice if he was speaking with AAA, a woman answered, “No, this is your mother.”Seeing that Driscoll was unsteady on his feet and allegedly intoxicated, police asked him for his license and how much he had to drink that evening. Saying he had just come from Salem State University, Driscoll admitted to only having one glass of alcohol and began slurring obscenities when asked to perform field sobriety tests. At one point, police say Driscoll became boisterous and lunged at an officer in an aggressive manner similar to a fighting stance.After allegedly yelling at the officers and violently resisting arrest, Driscoll was placed in handcuffs, while his van was searched. A black backpack was found between the driver and passenger seat with open bottles of Smirnoff Vodka and Kahlua.During Driscoll’s booking, police say they had to pepper spray him because he continued to act aggressively toward officers and was later taken to Salem Hospital. Officers attempted to administer a Breathalyzer test at the hospital but, with Driscoll continuing to allegedly yell, spit and swear at people, it was not completed.
