LYNN – Police arrested a Lynn woman on Saturday after she allegedly punched and clawed her 4-foot, 11-inch tall disabled former jockey boyfriend, who in turn assaulted her in a heated argument over drugs.Hector R. Diaz, 61, of 249 Lantern Road, #26, Revere, was charged with domestic assault and battery; Maria I. Rios, 39, of 16 Van Buren Terrace, was charged with assault and battery on a disabled person over 60 years old and domestic assault and battery.Both suspects were arraigned Monday at Lynn District Court by Judge Stacey Fortes-White and released on personal recognizance under the conditions of no abuse and abiding by each other’s restraining orders. A pre-trial hearing has been scheduled for March 3.According to court documents, Lynn police responded to A&S Market on Commercial Street on a report of a domestic disturbance. Upon arrival, police were told Rios was in the store’s bathroom, crying and being uncooperative.When asked what happened, Rios alleged that her boyfriend, Diaz, began punching her while in her car after he accused her of doing drugs. She said she was driving back from Winthrop and that the assault happened by Raffi’s Place on Summer Street. After jumping out of the car, she said she walked over to the market and called police for help.Claiming to not know where her boyfriend lives, Rios continued to be uncooperative with police and left a few minutes later. As officers began filing a report on the incident, Diaz walked into the front lobby of the police department, allegedly covered in scratches on his face and neck that were bleeding. He told police that he went with Rios to visit her cousin in Winthrop, but decided to stay in the car while she visited and then got mad because she took too long.He said he started arguing with her and accused her of doing drugs. At that point, Diaz alleged that Rios began throwing punches at his face and gouged her fingernails into his face. He went on to say that once Rios made it to Lynn, he pulled the shifting level to park the car and turned it off as she jumped out to get away.Police then arrested Diaz for assault and battery and arrested Rios at her home a short time later. While Rios was being led to a cruiser in handcuffs, she told her son, “I got into a fist fight with Hector” when asked why she was being arrested.Police say an elder abuse report was filed and a copy of the report was faxed to the CRW center in Revere.
