SALEM – Attorneys in the case against Lynn police officer Geovanni Ruano say they are not going to file any preliminary trial motions and will be looking for a trial date at their next court hearing.Ruano, 46, of 15 Osborne St., Lynn, is a 13-year police department member who is currently on unpaid administrative leave. He is charged with assault and battery with a dangerous weapon and witness intimidation in connection with a road-rage incident in July when he allegedly physically assaulted a then 24-year-old man on Atlantic Terrace and Ocean Avenue.Defense Attorney Thomas Drechsler appeared Tuesday morning in Salem Superior Court informing Judge John T. Lu that he has reviewed all the information provided to him by prosecutors and determined that he will not be filing any preliminary trial motions.Defense lawyer Neil Rossman, representing Catherine Foley, who is charged with witness intimidation in connection with the case, concurred with Drechsler regarding his client’s defense also.The attorneys agreed to continue the case to March 21 to set down a trial date.Assistant District Attorney Maureen Wilson-Leal said she expects the case to go to trial sometime in the summer.Prosecutors say Ruano, who was driving a 2003 Chevy Tahoe, followed Richard Zelandi down Nahant Street on the night of July 31 flashing his headlights.Zelandi told police he took a left in his BMW convertible onto Atlantic Terrace and pulled over.Ruano stopped his Chevy, got out, identified himself as a Lynn police officer, while apparently speaking to Zelandi in a threatening manner.Zelandi said he was unsure if Ruano actually was an officer and asked to see his badge. They then both agreed to walk over to the Tahoe where Zelandi said he was physically assaulted by Ruano, who tossed him onto the hood of his trunk.Afterwards, Zelandi began to walk back to his car and Ruano allegedly jumped back into his Chevy, put it into drive and struck Zelandi.Zelandi said he grabbed onto the truck’s hood as Ruano continued to drive. Then Ruano slammed on his brakes and Zelandi bounced off onto a parked car, suffering neck and back injuries before Ruano sped away from the scene.The following day after the incident, prosecutors say Ruano and his girlfriend, Catherine Foley, 32, went to the victim’s apartment on Ocean Avenue and apparently made “implied promises” to Zelandi in which they tried to encourage him to “not” make the incident from the night before a “court matter.”Ruano and Foley currently remain free pending the outcome of their case.
