SAUGUS – A Saugus man was caught allegedly driving drunk at 5 mph on Route 1 south with two tires missing from his BMW on Monday night.Daniel Silva, 61, of 32 Walden Terrace, was charged with operating a motor vehicle under the influence of alcohol, negligent operation of a motor vehicle, marked lanes violation, failure to stop and or yield. He was arraigned Tuesday at Lynn District Court by Judge James Wexler and released on personal recognizance. A pre-trial hearing has been scheduled for June 24.According to court documents, a state trooper on patrol on Route 1 near the Lynnfield Tunnel said he smelled burnt rubber and saw a large cloud of smoke coming from a car that was weaving between the breakdown lane and the travel lane. As the trooper attempted to pull the car over, the driver, later identified as Silva, allegedly drove up on the sidewalk, where the trooper said he could see that both right tires were missing and that the car was driving on its rims.After allegedly driving through a stop sign, Silva pulled over. The trooper said a strong odor of alcohol emanated from Silva?s window, and he could see that Silva?s eyes were bloodshot and glassy. With slurred speech, Silva allegedly told the trooper he was “coming from Brutole” and that he was trying to get home because he was missing a tire.After stumbling out of his car, the trooper said Silva swayed from side to side as he walked. When asked if he had anything on him, he allegedly said, “yeah, a gun” and laughed, saying he was joking. He allegedly went on to say that he had two glasses of wine, but also took Vicodin for back pain.After allegedly failing several tests, Silva was placed under arrest and taken to the Danvers barracks. While there, Silva allegedly yelled a slew of obscenities at the trooper because his handcuffs were too tight, and later fell face forward against a wall.During his booking, Silva was allegedly uncooperative one minute, then crying the next, and laughing while apologizing. After refusing to do a Breathalyzer test, his license, from the Caribbean islands Turks and Caicos, was seized and suspended.
