LYNN – A judge ordered $2,500 cash bail and that a city man be held for up to 60 days for violating a bail warning, after police said the man tried to strangle two of his sisters during a fight.But a defense attorney said her client denied the allegations, and noted the man had scratches and bite marks as a result of the alleged incident.Christian Garcia Jr., 25, of 1 Olive St. #1, was arrested and charged with attempted murder, two counts; and assault-and-battery, two counts; at 8:21 a.m. Sunday.Police also arrested and charged one of the sisters, Mariant Garcia, with domestic assault-and-battery; and assault-and-battery with a dangerous weapon, a glass cup.A second sister, Michelle M. Garcia-Vargas will be summonsed for domestic assault-and-battery.Christian Garcia and Mariant Garcia were arraigned Monday in Lynn District Court.Police responded to the Olive Street address early Sunday morning and found Christian Garcia – who told police that he had called them ?waiting outside and Garcia-Vargas inside the apartment, according to a report by Lynn Police Officer Sadrak Pierre.Garcia-Vargas told police she left the bathroom when Christian Garcia “gave her an attitude” and insulted her, according to the report. She said she replied but Christian Garcia did not hear exactly what she said, and she went into her bedroom, according to police.Garcia-Vargas told police her brother then broke the door, pushed her to the ground and began strangling her. Mariant Garcia then attacked Christian Garcia, Garcia-Vargas told police.”Christian Garcia then let go of victim Michelle Garcia-Vargas, and attacked (Mariant) and slammed her on the floor on her back, and he then started to choke her as well,” Pierre wrote.Police reported observing a red mark under each female victims’ necks consistent with attempted strangulation.Christian Garcia had a different version of events, however.He told Lynn Police Officer Fabio Silva that he went into the bathroom after Michelle Vargas-Garcia and saw she had left her cellphone in the room. But he said she accused him of stealing the phone, and she and Mariant Garcia attacked him when he left the restroom.”They started to yell at me,” Christian Garcia told police. “They jumped me and punched me. I pushed them away, then I held them.”Police reported Christian Garcia had two bite marks on his forearms, and multiple scratches on his neck and face. Christian Garcia also told police Mariant Garcia had tried to break a glass cup over his head, but police reported seeing no evidence of injuries from this allegation.Assistant District Attorney Erin Bellavia requested that Garcia’s bail be revoked in prior cases where he was alleged to have threatened individuals with a gun. Bellavia noted that Lynn District Court Judge Ellen Flatley had found Garcia to be dangerous on May 7 and ordered him released on $1,000 cash bail and conditions including that he not commit another offense.But Defense Attorney Joann Hnat said that Christian Garcia’s version of events was more credible than his sisters’ version.She also asked that the judge not revoke bail. She said Christian Garcia had only gotten in trouble in the last month and his open case involved three or four witnesses, only one of whom reported seeing Christian Garcia with a gun.Judge Matthew Machera noted Monday that Judge Flatley had released Christian Garcia on conditions and ordered his bail revoked and thus held for up to 60 days. Machera also set $2,500 cash bail on the new charges. Christian Garcia is scheduled to return to court for all cases on July 17.Mariant Garcia was given a bail warning and released on personal recognizance.
