LYNN – A judge ordered a city man held without bail after a woman told police she walked in on the man with his hand up the skirt of her 13-year-old relative.”When she opened her bedroom door, she observed (the defendant) between (the victim’s) legs and his hand was up her skirt,” Lynn Police Officer Joseph Chadbourne wrote in a report. “He stated that he was looking for some shoes under the bed.”Gerlin Nunez, 32, of 35 Camden St., was arrested and charged with rape of a child with force; assault-and-battery on a child with injury; and indecent assault-and-battery on a child under 14 on Monday.A not guilty plea was entered on Nunez’s behalf at his arraignment Tuesday in Lynn District Court.Attorneys did not discuss the details of the case in open court.Essex Assistant District Attorney Erin Bellavia requested Nunez be held without bail pending a dangerousness hearing.Public Defender Jeffrey Sweeney said his client stipulated to probable cause for the hearing and requested a further date.Court documents reveal the alleged victim reported Nunez had repeatedly sexually assaulted her over the past three years.The alleged victim told police Nunez came into the relative’s bedroom where the victim was watching television Sunday, police said.The alleged victim said Nunez forced her down on the bed and began molesting and then raping her until the relative walked into the room, according to the report. The alleged victim also told police she hit Nunez with her iPad to stop him from molesting her in an incident the previous week.Judge James LaMothe ordered Nunez held without bail pending a dangerousness hearing scheduled for July 23.Cyrus Moulton can be reached at [email protected].
