LYNN – A judge ordered $2,500 cash bail for a city teen who a prosecutor said sent a man to three hospitals and two surgeries with a punch in the face after the teen approached the man looking for a cigarette.”He had to receive two surgeries already ? and there likely will be more in the future in an attempt to save his eye,” Essex Assistant District Attorney Aimee Conway said in Lynn District Court on Wednesday. She said doctors anticipate that, despite surgeries, the alleged victim’s eye will never be fully healed.The judge also revoked a continuance finding the teen received for prior assault charges, likely sending that case to a trial.Jelame Garcia, 18, of 3 Circuit Ave., was arrested on a warrant for aggravated assault and battery on Tuesday.He was arraigned on the charge Wednesday in Lynn District Court, where he pleaded not guilty.Conway said police responded to a report of an assault on Milton Street at approximately 1:43 a.m. July 12 and found a man unconscious on the ground.A witness told police he and the alleged victim, 52, had been sitting on a porch when a man – later identified as Garcia but a stranger to the alleged victim and witness – approached and asked them for a cigarette, Conway told the court.Conway said Garcia returned later and asked the witness for another cigarette. But the witness told police he told Garcia had gotten the cigarettes from the alleged victim who had just started to walk home. The witness said Garcia approached the alleged victim and the witness saw Garcia punch the alleged victim in the face, according to Conway. She said a second witness corroborated this account.The victim’s brother, who had been Garcia’s teacher, the witness and a police officer investigating Garcia for an alleged rape, each identified Garcia as the suspect from a surveillance video showing the alleged incident, Conway said.Charges against Garcia and a codefendant in the alleged rape were dismissed without prejudice – meaning the charges can be filed again – on March 12 after the alleged victim failed to appear for the probable cause hearing, according to Essex District Attorney spokesperson Steve O’Connell.Conway requested Garcia’s bail be revoked in an open case where she said the defendant is alleged to have assaulted his parents. She also requested a general continuance be revoked in another case and $5,000 cash bail for the new charges.Court appointed defense attorney Joseph MacDonald said Garcia denied being involved in the alleged incident and works three jobs in addition to being a student in high school. MacDonald said he had not seen the video, however, so could immediately argue the alleged facts of the case. He requested a $2,500 cash bail, acknowledging the charges were serious.Judge Joseph Jennings ordered Garcia held on $2,500 cash bail and revoked the general continuance finding. Jennings rejected the Commonwealth’s request to revoke bail in the open case.Garcia is scheduled to return to court Sept. 18.
