LYNN – A judge released a Revere man Friday but ordered him not to drive after police said the man was negligent when he fatally backed over a city woman with his vehicle in July. “I have concluded that (the defendant) was operating ? in a reckless manner by failing to use care while backing up and driving over (the victim) causing injuries that led to her death,” Lynn Police Officer John Meaney wrote in a report.Milan Zilic, 57, of 16 Sumner St. #2, Revere, was summonsed to Lynn District Court on Friday morning where he was arraigned on charges of motor vehicle homicide by reckless or negligent operation; manslaughter; and negligent operation of a motor vehicle, according to court records.Police identified Zilic as the driver of a 1998 Honda Odyssey that fatally struck Kathleen McPartland, 60, of Lynn, on July 21.Police reported responding to a parking area near the intersection of Boston and Hamilton streets on the Lynn and Saugus line and finding McPartland dead.Zilic told police at the scene he had been fishing and was backing up to leave from his parking spot when a male witness yelled at him to stop, according to court documents.”Zilic said he was unaware he had hit anything until after (the witness) came to the driver’s window yelling at him to stop,” Meaney wrote.But police reported Zilic filed a crash report a few days later that said McPartland stepped out from behind a parked truck while he was backing up, causing Zilic to hit her.”This report conflicted with the statement given after the crash,” Meaney noted.Two witnesses each told police that Zilic appeared confused around the time of the accident.The male witness told police he heard a loud thud and could see the victim underneath the van. But that witness said the driver was still trying to back up and “did not seem to understand what was happening,” according to police.A female witness said Zilic “seemed confused” and got out of his van and tried to open the passenger side rear door “for an unknown reason” while the victim was underneath the car.Meaney noted Zilic spoke broken English at the scene, and his arraignment required a Croatian interpreter.A third witness reported she rescued a baby from a stroller the victim had been pushing and that was tipped over onto the ground after the crash.Meaney noted there was no indication of alcohol or drug intoxication. But Meaney noted Zilic’s contradicting accounts of the incident. Meaney also said there was “no evidence to suggest” that Zilic’s view was obstructed when he was backing up.Lynn District Court Judge Mary McCabe ordered Zilic released on personal recognizance but ordered him not to drive while the case is pending and to surrender his passport upon his return from a trip, according to court documents.She scheduled Zilic to return to court Oct. 11.Defense Attorney Michael Hickey said he could not comment on the alleged facts of the case as he had seen only the police report.”There’s going to be a lot more work and work product from the Lynn Police Department and the State Police Accident Reconstruction,” Hickey said. “It’s just a very sad accident.”
