LYNN – A judge ordered a city man held without bail after a man lying in the middle of Beacon Hill Avenue Friday morning said the defendant stabbed him in the head. But the defendant – and later even the alleged victim – denied a stabbing occurred.”(The defendant) claimed it was not a stabbing, that his friend fell,” Lynn Police Officer Albert DiVirgilio wrote in a report. “His friend now arrived on scene, our victim ? and claimed he was mistaken and now had fallen. Officers phoned the North Shore Medical Center Salem where he was treated and the charge nurse stated that the doctors notes stated it was a stab wound.”Rafael E. Delarosa, 36, of 57 Beacon Hill Ave. #2, was arrested and charged with assault and battery with a dangerous weapon; at 4:15 p.m. Friday.He was arraigned on the charge Monday in Lynn District Court where a plea of not guilty was entered on his behalf, according to court documents.Police responded to Beacon Hill Avenue at 9:15 a.m. Friday where they found the victim lying in the middle of the street, according to police. The victim told police he and Delarosa were at the latter’s home when Delarosa stabbed him, according to the report. The alleged victim told police Delarosa fled up Beacon Hill Avenue, possibly in a red Nissan Altima, police said.Police reported finding a large blood spot on the couch in Delarosa’s apartment. But officers did not find the suspect until later that evening when they saw a red Nissan Sentra near the Beacon Hill Avenue address, according to police.Delarosa was in the shower, and began yelling obscenities at his friend, the alleged victim, when arrested, police reported.Essex Assistant District Attorney Shailagh Kennedy requested Delarosa be held without bail pending a dangerousness hearing. Lynn District Court Judge James LaMothe granted the request, scheduling the hearing for Thursday.An attorney for Delarosa could not be reached for comment Tuesday evening.
