LYNN – A judge ordered $15,000 cash bail for a city man who police said videotaped a 7-year-old girl dancing and exposing herself, and grinding against the man’s backside.”In the second mentioned video, (the defendant) can be heard encouraging (the alleged victim) as she gyrates and lifts her clothes by saying in Spanish, ?but you have to sing like Shakira. Shakira the Crazy. How does that go? I am crazy like a tiger. Crazy. Crazy. Crazy,'” Lynn Police Officer Joseph Chadbourne wrote in a police report.But the man’s attorney said his client only followed the alleged victim’s wishes.”What’s left out of the police report, inexplicably to me, was he gave a statement to Lynn Police ? that put the allegations in a completely different light,” court-appointed defense attorney Nicholas Morris said. “He never enticed her to get out of her clothes. That was entirely of the young girl’s own volition.”Hugo Garcia, 32, of 740 Boston St., was arrested on a warrant for exhibiting a child in the nude; on Jan. 24.He was arraigned in Lynn District Court Monday where a plea of not guilty was entered on his behalf.Essex Assistant District Attorney Erin Bellavia, summarizing from Lynn Police reports, said the alleged victim’s father was trying to fix his daughter’s tablet computer when he discovered two “disturbing” videos. In the videos, the man’s daughter was undressing and touching herself, exposing her buttocks, breasts and vagina while a Hispanic male filmed, according to police and prosecutors.She said the child also grinds up against the man’s backside in two of the videos.The child’s mother, who was separated from the child’s father, identified the man as Garcia, a friend who occasionally stayed at her house, according to court documents. The mother told officers she did not know about the videos until her ex found them, according to Chadbourne’s report.Bellavia requested $50,000 cash bail for the charge and that Garcia have no contact with children under 16.But Morris said the story was “completely blown out of proportion.” Garcia simply filmed the girl – whom he had known since she was 2 years old and he began dating the child’s mother – as the alleged victim danced however she wanted, Morris said. He said Garcia also told the mother about the videos as soon as they were made.”It wasn’t a big deal at the time because Mr. Garcia appropriately told the mother what happened,” Morris said. Then he noted the couple broke up and the father saw the videos. “She never reported her daughter in the video to the police department, but her hands were tied when the father found out.”Morris requested $3,000 cash bail, acknowledging the serious charge.Judge Stacey Fortes ordered $15,000 cash bail and that Garcia have no contact with children under 16 or the alleged victim and witnesses. Garcia is scheduled to return to court Feb. 25.
