A judge ordered a city man held on a potential probation violation and set $1,000 bail for an assault charge after the man allegedly beat his disabled girlfriend while drunk.”For the victim’s safety and (the defendant’s) safety, I think he should be held until we find a place for him, because he has some serious issues,” Lynn District Court Probation Officer Paul Hickey testified Wednesday.Aubrey Winbrone, 58, of 8 Joyce St. #4, was arrested and charged with domestic assault and battery; at 4:49 p.m. Tuesday.He was arraigned on the charge Wednesday in Lynn District Court where a plea of not guilty was entered on his behalf.Police responded to the Joyce Street apartment and were immediately greeted by the alleged victim, who had a large cut across her forehead and a swollen face.”When asked how that injury had occurred she stated, ?he did it to me,'” Lynn Police Officer Ralph Sirois Jr. wrote in a report. The alleged victim told police Winbrone had struck her in the face.Police reported finding Winbrone swearing loudly while seated on the couch with several tall Natural Ice beers in front of him and a puddle of urine on the floor beneath his feet.Essex Assistant District Attorney Erin Bellavia told the court that the charge may be amended as the alleged victim is in a wheelchair and was seriously injured in the alleged attack. Indeed, the alleged victim testified for a restraining order after the arraignment and one could see a large cut across her forehead and a bruised face. Bellavia requested Winbrone be held on $1,500 cash bail and that he abide by the terms of the restraining order.Court-appointed defense attorney John Ruehrwein said Winbrone had an alcohol problem and potential mental-health issues. Ruehrwein requested the defendant be released on personal recognizance to attend a program for treatment.But Ruehrwein acknowledged Winbrone would have to stay with a relative until a bed in a program could be found.Hickey requested Winbrone be detained for potentially violating probation on a previous case and that, during that time, probation and the family could try and find a treatment program for Winbrone.Judge James Wexler agreed Winbrone should seek treatment and ordered the defendant held on a potential probation violation and set $1,000 cash bail for the new charge.Winbrone is scheduled to return to court April 4.
