LYNN – A judge ordered a Randolph man held without bail pending a dangerousness hearing a day after the defendant allegedly drove into a man after being kicked out of the courthouse for disrupting a dangerousness hearing.Herve Viaud, 23, of 90 Cross St., Randolph, was arrested and charged with assault and battery with a dangerous weapon, a car; carrying a loaded firearm without a firearms identification card; witness intimidation; leaving a firearm in a vehicle; and a felon in possession of a firearm; at 3:06 p.m. Thursday. He pleaded not guilty to the charges Friday in Lynn District Court. The crash stemmed from disputes during a dangerousness hearing at Lynn District Court Thursday for Viaud’s brother, Luis Viaud, 24, of Dorchester.Luis Viaud was held without bail pending the hearing after police said Luis Viaud strangled his child’s mother on Aug. 24 and then threatened to burn down the shelter where she and the child were staying if she called police. The dispute from the dangerousness hearing continued outside the courthouse on Thursday.Police responded to Sutton Street by the courthouse parking lot at approximately 2:30 p.m. Thursday on the report of a possible fight. Police saw several people arguing and standing around a gold Chrysler, and then saw Herve Viaud get into the car and drive into another man, according to police. The alleged victim was thrown across the street into a Ford pickup, causing a large dent, and was injured in the legs, police reported.Police said the Chrysler tried to leave but couldn’t get around the alleged victim’s body.A woman (the alleged victim in Luis Viaud’s domestic case) told police Herve Viaud and his girlfriend got into an argument with her in court after she accused them of lying about witnessing the event involving her and Luis Viaud.”Herve Viaud then looked at (the woman) and stated, ?you (expletive) rat, I’ll slap you and that (expletive) you with,'” Lynn Police Officer Ashley Affonco stated the woman said. “At this time the court officers removed Herve Viaud and his girlfriend.”The woman told police that as they left the courthouse, Herve Viaud and his girlfriend called her, her new boyfriend and her friend over “to talk things out,” police said. The woman said she was nervous, because Herve Viaud was rummaging through his trunk and she knew he had guns on him at all times. The argument continued and Herve Viaud started recording her on video.Police reported the video showed the woman following Herve Viaud and insisting she was “not a snitch.” The trunk of the Chrysler opens at some point and Viaud “then continues his rant by telling her ?get with me in the hood,’ and ?I’ll pop the trunk on this (expletive) ass (expletive),'” Lynn Police Officer Michael O’Connell, who watched the video, reported.Police said the screaming continued on both sides and then Herve Viaud got into the car and drove into the woman’s new boyfriend.Police reported searching the Chrysler’s trunk and finding a semi-automatic handgun, for which Herve Viaud had no license. At Herve Viaud’s arraignment, a prosecutor requested the defendant be held without bail pending a dangerousness hearing. Judge Cathleen Campbell (who Thursday found Luis Viaud to be a danger and ordered him held on $1,000 cash bail) found probable cause for the request and scheduled the hearing for Sept. 16.
